Welcome to Smarthost.MX! These Terms and Conditions ("Terms") govern your access to and use of the SMTP relay services provided by Neowyze Technologies, LLC ("Smarthost.MX," "we," "us," or "our"), a company registered in Wyoming.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
Service(s): Refers to the SMTP relay service provided by Smarthost.MX, including all features, functionalities, and related support.
User(s) / Customer(s) / You: Refers to any individual or entity that registers for, accesses, or uses the Services.
Transactional Emails: Refers to automated, non-promotional emails sent in response to a specific action by a user or an event, such as password resets, order confirmations, account notifications, form submissions, or scan-to-email system messages.
Marketing/Bulk Emails: Refers to unsolicited commercial emails, newsletters, promotional content, or any emails sent to a large group of recipients without their explicit, verifiable consent for that specific type of communication.
DNS: Domain Name System.
DKIM: DomainKeys Identified Mail.
SPF: Sender Policy Framework.
DMARC: Domain-based Message Authentication, Reporting, and Conformance.
By registering for an account, accessing, or using any part of the Smarthost.MX Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Neowyze Technologies, LLC.
Smarthost.MX provides an SMTP relay service primarily designed for the reliable delivery of business and transactional emails. Our Service is specifically engineered for:
Alert notifications
Form submissions
Scan-to-email systems
Other legitimate business communications
As a User of Smarthost.MX, you agree to:
Domain Ownership/Access: You must own or have full administrative access to any domain name from which you send emails through our Service. This is required for proper DNS configuration.
Valid "From" Addresses: All "From" email addresses used must be valid, actively monitored, and capable of receiving emails. We may require verification of ownership for these addresses before allowing relay.
DNS Configuration: You are solely responsible for correctly configuring your DNS records, including DKIM, SPF, and DMARC, according to the instructions provided by Smarthost.MX. Proper configuration is essential for email deliverability and reputation.
Prohibited Content and Activities: You shall not use the Service to send, transmit, or facilitate:
Spam (unsolicited bulk email)
Phishing attempts
Malware or viruses
Illegal content or activities
Any content that violates applicable laws or regulations.
No Emailing Lists: Our Service is not designed for, and you are prohibited from, emailing purchased lists or maintaining opt-in lists for marketing purposes. All emails must be legitimate business emails.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Smarthost.MX immediately of any unauthorized use of your account or any other breach of security.
Abuse Reports: While we do not filter or view the content of your emails, we will investigate any abuse reports received (e.g., spam complaints). If an investigation confirms a violation of these Terms, your account may be terminated immediately.
Service Tiers: Smarthost.MX offers various service plans with different maximum limits on the number of emails that can be relayed per month, the maximum number of "send from" email addresses, and the maximum number of "send from" domains.
IP Addresses: Some plans include dedicated static IP addresses for email origination, while lower-tier plans utilize shared IP addresses.
Usage Monitoring: We log sender IP, username, the number of recipients successfully delivered, and the number of bounces. We do not store email content.
Usage Notifications: You will receive a notification when your monthly email usage reaches 90% of your plan's maximum allowed emails.
Usage Limits: Once you reach your monthly email limit, you will be notified, and the system will prevent further email sending until you either upgrade your plan or the 1st of the next month (0:00 UTC).
Payment Processing: All payments for Smarthost.MX services are processed securely through Stripe. We accept various payment methods supported by Stripe, including credit cards, Google Pay, and Amazon Pay. For details on Stripe's terms, please refer to Stripe's Terms of Service.
No Payment Information Storage: Smarthost.MX does not store your payment card details or other sensitive payment information. All such information is handled directly by Stripe.
Subscription Management: You can manage your subscription and payment methods directly through your account, which integrates with Stripe.
Billing Cycle: Subscriptions are billed according to the chosen plan (e.g., monthly, annually).
Cancellation: You may cancel your subscription at any time. Your Service will remain active until the end of your current billing period, after which it will terminate.
Refunds: Refunds are generally not provided for Services already rendered. A refund may be issued only if Smarthost.MX is unable to provide the Services due to:
Inability of your systems to communicate correctly with our Service (e.g., lack of encryption support).
Your inability to specify or verify the "send from" email address as required.
Credits for Downtime: In the event of significant Service downtime exceeding one (1) continuous hour that is directly attributable to Smarthost.MX, a credit may be issued against future service fees at our sole discretion.
Email Content: Smarthost.MX does not store the content of your emails. Emails are queued on our servers and are deleted upon successful delivery or if they are bounced.
Logging: We log only sender IP, username, number of recipients successfully delivered, and number of bounces for operational purposes and abuse prevention.
Inactive Account Data: When you cancel your service, your name, email, and company name will remain in an inactive state in our system to facilitate potential reactivation.
Data Erasure Request: If you wish to have your data completely erased from our systems, please contact us via our contact page at https://smarthost.mx/contact.php or by emailing [email protected].
No Guarantee of Deliverability: While Smarthost.MX makes every effort to ensure maximum uptime and email deliverability, we do not guarantee that all emails will be delivered successfully. Factors beyond our control, such as issues with upstream providers, recipient mail server policies, or internet outages, can affect delivery.
No Business Impact Responsibility: Smarthost.MX shall not be held responsible or liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the inability to use the Service or the failure of emails to be delivered correctly.
Service "As Is": The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Smarthost.MX reserves the right to suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, fail to make payment, or engage in any form of abuse of the Service.
Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
